Nursery (B) Sdn Bhd and the terms “You” / “Visitor” / “User” / “Customer” refer to the clients. Users should visit this page periodically to review the Terms and Conditions as RGC reserve their rights to revise these Terms and Conditions at any time by updating this posting. Any changes to the Terms and Conditions will be updated on the site and such changes be effective immediately. You agree that any information we hold about you whether prior or after the changes will be governed under the latest version of the Terms and Conditions.

If you do not agree with any of these terms, please do not use the Website. Your continued use of the Website following any changes to any Terms and Conditions means that you accept these changes. The materials contained in this Website are protected by applicable copyright and trademark law.

The materials on RGC’s website are provided on an as is basis. RGC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, RGC does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its web site or otherwise relating to such materials or on any sites linked to this site.
SECTION 3 – USER LICENSE
All logos, brands, marks headings, labels, names, signatures, numerals, shapes or any combinations thereof, appearing in this site, except as otherwise noted, are properties either owned, or used under license, by the business. Permission is granted to temporarily download one copy of the materials (information or software) on RGC’s website for personal, non-commercial transitory viewing only. SECTION 4 – WEBSITE RULES
Visitors are prohibited from violating or attempting to violate the security of the Website, including, without limitation to accessing data not intended for such user or logging into a server or account which the user is not authorised to access, attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorisation, attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting virus to the Website, sending unsolicited electronic mail, including promotions and/or advertising of products or services.
Violations of system or network security may result in civil or criminal liability. RGC has the rights to investigate occurrences that they suspect as involving such violations and will have the right to involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.
SECTION 5 – MEMBERSHIP
RGC’s online product and services are only available to registered users, thus visitors must register as a Member to make purchases through the Website.
Representations and Warranties. You represent and warrant that:
Membership Termination. RGC also reserves the sole right and discretion to temporarily or permanently suspend or terminate any membership if a member is, in RGC’s opinion, not acting in good faith, abusing the services of this Website, or otherwise in breach of the Terms and Conditions.
If your membership is suspended or terminated for any reason, you are not eligible to use this Website. In the event that you have a valid Order pending at the time your membership is terminated, RGC shall have the sole discretion and authority to fulfill the order or to refund the payment made less any administrative or other charges which RGC considers appropriate.
Indemnification. You agree to indemnify RGC and our affiliates, employees, directors, officers, agents and representatives, and to hold them harmless from any dispute and/or litigation and any and all losses, damages, actions, claims and liabilities including legal fees and costs on a full indemnity basis which may arise from or in connection with or in relation to, directly or indirectly, your breach of the Terms and Conditions including, without limitation to, any dispute and/or litigation filed by any third party.
SECTION 6 – TRANSACTION AND DELIVERY
Orders and Transactions. Payment for all orders shall be made in Brunei Dollars via MasterCard, Visa, JCB or American Express. We currently do not accept Cash on Delivery or Cash on Pickup. RGC reserves the right, at its sole discretion, to refuse or cancel any online transaction or order for any reason at any time. Some situations that may result in an online transaction being rejected or cancelled include where problems are identified by RGC’s credit and fraud control, where there is reason to believe that the online transaction is unauthorized, violates any law, rules or regulations or may otherwise subject RGC or any of our affiliates to liability.
Rewards Programs. RGC may offer various rewards programs, such as by collecting bonus points allocated to items sold. RGC may amend and void any bonus points, as well as limit, suspend or terminate your ability to participate in any Rewards Program in its sole discretion. Users of the Website agree to abide by the final and binding decisions of RGC regarding any Rewards Program and their participation in it. Furthermore, RGC is not responsible for or is obligated to award points for any activity that is not properly recorded, tracked or deemed approved under the Website’s or its third-party Rewards Program affiliates’ policies, procedures and systems. RGC reserves the right to request and verify receipts of completed purchases prior to awarding or amending points to verify shopping activities. Bonus points are non-transferable, may not be sold and are void if a transfer is attempted. Bonus points will remain valid for 6 months from date of purchase. Any bonus points not redeemed within 1 year will expire and removed from the user’s account.
Discount codes. RGC may offer customers a range of discounts in the form of discount codes through its membership loyalty program, bonus point redemption, special promotional discount code or gift coupons. As such, customers will only be allowed to select ONE discount code from these offerings: member discount, bonus point redemption, special promotional discount code or gift coupon. The use of any types of discount codes are only valid for the time specified by RGC. RGC’s decision on all matters relating to rewards, discounts and other privileges are considered final and binding.
Refund and Cancellation. Items purchased through the Website are strictly non-returnable and non-refundable, unless it is at the fault of RGC provided the reasons are genuine and proved after investigation. Any request to return and inquire refund should be made through our customer hotline at +673 8878897 or info@rimba-garden.com within 3 working days upon receiving orders. We strongly advise you to read all the provided details of items before making purchases. Refunds will be issued via cash transaction upon meeting clients at the specified delivery or billing address.
Security Checks. RGC may also require additional verifications or information for any online transaction. After an order is placed at RGC, a Customer Service Representative may contact the member to verify the member’s details in an effort to minimize fraudulent transactions. RGC’s credit card merchant may also require new credit card transactions over a predetermined value be subject to a security check.
Pickup in Our Store orders. Customers that select the “Pickup in Our Store” option during checkout are required to collect their parcels as soon as possible. In any event that customers take longer than 3 days to collect their items, RGC will not be liable for any damage and will not compensate or swap the items with a same but new product, particularly if items ordered are fresh and perishable. RGC will have the authority to contact all customers to check on their specified timing to pick up order as well as make follow up inquiries if parcels are not collected for a prolonged period of time.
Delivery services. In an attempt to deliver your purchased products in the finest condition and on time, RGC has appointed a local courier service provider to deliver your products to you as early as possible. For shipping addresses within Brunei Muara area, orders through the Standard Rate option will be delivered 1 – 3 working days after it has been dispatched from our warehouse. Under the Express Rate delivery option, orders before 3PM will arrive on the same day while orders after 3PM will arrive on the next day, or same day subjected to availability of dispatchers. For shipping addresses outside of Brunei Muara, delivery will be on a scheduled basis, depending on availability of dispatchers.
We strongly encourage customers to select the “Express rate” for all fresh and perishable items, as we will not be held accountable for any damages on products after they have been dispatched from our warehouse.
For purchases of items that are beyond the capacity of our outside courier service provider, RGC will personally deliver those items and provide any installation services, charged as per rate stated on item page, where necessary. Deliveries done by outside courier service provider may be subjected to their terms and conditions which may not be made known to RGC.
Delivery rates. All delivery rates are calculated based on total volumetric weight of orders, and made known to you upon checkout. In an event of any shortfall in payment, or overpayment, RGC reserves the right to amend, charge or refund you at the time of delivery.
Receiving orders. For “Pickup in Our Store” orders, customers are required to present their Order Receipt in the form of a physical or digital copy to an RGC staff, as well as provide signature upon receiving the items. For deliveries, customers are also required to sign upon receiving parcels from the dispatcher. In both cases, RGC may ask for a photograph to be taken upon delivering your parcels, however this will only be done with the customer’s consent. In any event that you have provided our dispatchers with the authority to leave your parcels with an identified receiver that is not you, all risks in the parcel will remain with you and RGC will not provide any replacement or refund for any loss or damage if items are not handled rightfully.
SECTION 7 – LIMITATIONS
Under no event shall RGC or its suppliers be held liable for any damages (including, without limitation to, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on RGC’s website, even if RGC or a RGC authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
SECTION 8 – ACCURACY OF MATERIALS
The materials appearing on RGC’s website could include technical, typographical, or photographic errors. RGC does not warrant that any of the materials on its Website are accurate, complete or current. RGC may make changes to the materials contained on its Website at any time without notice. However, RGC does not make any commitment to update the materials.
RGC has not reviewed all of the sites linked to its Website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by RGC of the site. Use of any such linked Website is at the user’s own risk.
RGC may revise these Terms and Conditions for its Website at any time without notice. By using this Website you are agreeing to be bound by the current version of its Terms and Conditions.

It is RGC’s policy to respect your privacy regarding any information we may collect while operating our Website. Accordingly, we have developed this privacy policy in order for you to understand how we collect, use, communicate, disclose and otherwise make use of personal information. We have outlined our privacy policy as below.

Information collected are mainly registration information including, but not limited to name, address, e-mail address, phone numbers and date of birth, information about Activities on the Website including, but not limited to specifications of products, pricing and delivery information, statistical information including, but not limited to IP addresses, browser software, operating systems, pages viewed, number of sessions and unique visitors.
Any and all of the above information may be collected from you through the use of cookies or any other means shall collectively be referred to as “Collected Information”.
SECTION 11 – USE OF COLLECTED INFORMATION
We reserve the right to use the Collected Information for marketing and verification purposes, to contact you regarding any matters or communications relevant to your use of the Website, to enable transactions to be completed and determine credit worthiness. We do not sell, rent or pass the Collected Information to others without your consent.
We reserve the right to disclose the Collected Information to relevant authorities as we believe that such disclosure is necessary to protect our rights, property, the Website and/or users of the Website. In the event of sale, merger, change in control, transfer of substantial assets, reorganisation or liquidation of RGC, we may, in our sole discretion sell or assign Collected Information on and through the Website, including without limitation all information we have collected from users to one or more relevant third parties.
SECTION 12 – COMMUNICATIONS
RGC Website presents a real-time chat feature in which customers may directly talk to one of our staffs through WhatsApp. This feature requires you to submit your WhatsApp number, which we will keep a record of for our own use. We also provide email links on our “Customer Services” page that allows you to contact us directly with any questions or comments you may have. We may receive a confirmation when you open any e-mail that we send to you, if your computer supports such capabilities. If you send us any email, we will retain such email and your email address for response.

Cookies are alphanumeric identifiers that are placed by us on your computer’s storage system through your web browser to enable our systems to recognize your browser when you make future visits to our Website, and to store certain information (such as items placed in your shopping cart) between visits. We will do our best to ensure our Website is protected using reasonable security methods to prevent unauthorized access. You are to keep the login password safe, as we will not be responsible for any unauthorized use of password should you reveal it to anyone.

We reveal only the first two and last two digits of your credit card number when confirming an order, but we have to transmit the entire credit card number to the credit card processor or company during order processing.
